CIPD Blogs: Terms of use

We hope you are enjoying the CIPD’s venture into blogging. To ensure that comments enhance and not detract from our blogs, we have created a formal comment policy. This policy is under constant review.

CIPD blogs are open to everyone to read and we value conversation with both members and non-members. 

Comment moderation

We encourage you to leave a comment. In fact, your comments can be the basis for a new blog post, so do make sure you let our bloggers know that they stimulated you enough to respond. In return we only ask that you first register for the website and are respectful with what you write. In order to maintain the integrity of our blogs and their content,  all comments are moderated. 

Please be mindful that our readers are from diverse backgrounds with different sensibilities and opinions. Although we will not stifle discussion, please avoid harsh language and the use of profanity or we will delete your comment. 

While links to other useful websites and online resources are encouraged, we reserve the right to edit out personal email addresses and anything else we deem to be advertising. 
From time to time, we may direct commenters to appropriate discussion threads on the CIPD Communities, where the conversation can continue.

It will not be displayed (unless you type it into the body of your comment, which we will edit out) and you will not be subscribed to any mailing list by leaving a comment. CIPD Comment and Insight: Terms of Use (“C&I Terms of Use”)

These C&I Terms of Use govern your access to and use of the Website. By accessing and using the Website you agree that you have read and accept these C&I Terms of Use and that they shall apply to your use. If you do not wish to be bound by these C&I Terms of Use, please leave the Website.

1. Contact details
1.1. The Chartered Institute of Personnel and Development (“CIPD”) publishes and operates the website at the url http://www.cipd.co.uk including the Comment and Insight section as further defined herein (the "Website "). CIPD has the following trading subsidiaries: CIPD Enterprises Limited (“CIPDE”) and Bridge Management Training Limited (“Bridge”) (together CIPD’s “Subsidiaries”).

2. Comment and Insight
2.1. Comment and Insight at the url http://www.cipd.co.uk/comment-insight (“Comment & Insight”) is a section of the Website that provides information and expert opinion on a range of topical HR issues for the purpose of informing users and stimulating debate amongst those interested in these subject areas.
2.2. Comment & Insight comprises two alternative environments with differing characteristics as follows: 2.2.1. “Comment”: Comment is an environment in which a CIPD nominated expert (a “Contributor”) posts an article on a topical HR issue (a “Leading Article”) which may then be commented upon by other individuals who are either registered with the Website (“Registered Users”) or not registered with the Website (“Unregistered Users”) (together the “Users”). CIPD shall select at its discretion those comments which it considers most deserving to appear below the Leading Article for the benefit of all those who access Comment;
2.2.2. “Insight”: Insight is an environment in which a number of Contributors are invited to express a short opinion about a topical HR issue (a “Leading Opinion”) which Users may then also comment upon. Subject to compliance with these C&I Terms of Use, all comments shall appear within Insight;
2.3. You acknowledge that the service provided via Comment & Insight (the "Service") has the sole purpose of facilitating the transfer of information between Contributors and Users.

3. Registration
3.1. You may register with the Website by visiting https://www.cipd.co.uk/reg/istration.
3.2. In order to register with the Website you are required to submit your first and last names, email address, user name and password. You must also indicate whether you are a guest, CIPD member, a member through an organisational membership or a People Management subscriber. If you have any queries about your details on the CIPD database, please email database@cipd.co.uk
3.3. You are able to provide additional information including your postal addresses, another email address and sign up and or manage your newsletters subscriptions via the ‘My Profile’ area of the Website. You are not obliged to submit this additional information in order to register with or use the Website, but if you choose to do so, then, subject to paragraph 5 below, CIPD may use it in order to provide you with a more personalised service.
3.4. We may suspend and/or terminate (either in whole or in part) your use of any user name, password or this Website immediately for any reason.
3.5. By registering with the Website, your username and, where you have provided one, your photograph, will appear adjacent to any comments that you make within Comment & Insight.
3.6. Following registration, you will only be asked to enter your login details on the first occasion that you wish to submit a comment within Comment & Insight. Thereafter, you will be remembered within Comment & Insight provided that your web browser allows for cookies to be stored upon your computer or device. 4. Unregistered Users
4.1. Individuals are not required to be registered with the Website in order to comment within Comment & Insight.
4.2. Unregistered Users are required, however, to enter a username and email address before posting a comment and your username shall be displayed alongside your comment. Email addresses shall be stored in accordance with our Privacy Policy but shall not be displayed.
4.3. Unregistered Users will not be remembered on subsequent visits to Comment & Insight as no cookie shall be placed within your browser. Unregistered Users shall therefore be required to enter these details on each occasion that they wish to post a comment.

5. Data protection and privacy
5.1. For your security and peace of mind, CIPD and its Subsidiaries will not supply your details to any organisation for marketing purposes. Please view our Privacy Policy for further information.

6. Intellectual Property
6.1. All intellectual property rights in the design and layout of the Website and, save as described in 6.3 below, in the material and information published on the pages of the Website, including, but not limited to, copyright and rights in registered and unregistered trademarks, are owned by or licensed to CIPD.
6.2. Save as may be incidental to you obtaining authorised access to the content on the Website, you must not reproduce, download, transmit or retransmit, manipulate or store on paper, electronic (including, but not limited to any database or any part of the Internet), CD Rom or other offline product on any other format in whole or in part the design and layout of the Website or the information or material published on the pages of it, nor hypertext or, save for social bookmarking, otherwise link to it without the prior written consent of CIPD, such permission to be given or withheld at CIPD's absolute discretion.
6.3. Copyright in any comment made by you on Comment & Insight shall remain with you and by making a contribution (in whatever form, including but not limited to text, graphic, photo, other image type or audio) you agree to grant to CIPD, a free of charge, perpetual and irrevocable worldwide licence to use the comment in whatever manner it may wish, including for the avoidance of doubt, drawing third parties’ attention to it and allowing the comment to be reproduced by such third parties subject to the source of the comment being acknowledged.
6.4. In posting a comment to Comment & Insight, you confirm that your contribution is your own original work, is not defamatory, does not infringe any laws or the rights of others in any jurisdiction, and that you have the right to grant the CIPD a licence to use the materials as specified above.
6.5. If you do not wish to grant the CIPD a licence to use your contribution as envisaged by these C&I Terms of Use, please do not submit or share your comment on Comment & Insight.

7. Disclaimer
7.1. The material and information contained on the Website is for general information only and does not constitute any form of offer for sale (except for products available to purchase on our online sales website at http://www.cipd.co.uk/bookstore), advice or recommendation by CIPD. You should not rely on the material or information on the Website as a basis for making any business, legal or other decisions. You should seek appropriate independent advice before making any such decisions.
7.2. CIPD does not warrant or represent and excludes all warranties or representations that the material and information, including advertising material, on the Website is accurate, true or complete or that it is free of viruses or that it does not contain any material which is defamatory, obscene or illegal in any way.
7.3. In no circumstances will CIPD be liable to you or any other third parties for any loss or damage (whether direct or indirect, including loss of profits, loss of opportunity or any consequential loss) resulting from or in any way connected with your use of the Website or its content, whether caused by negligence, misrepresentation, breach of any statutory duty, or breach of contract or otherwise. CIPD does not limit or exclude its liability for death or personal injury resulting from its negligence.
7.4. The content contained within Comment & Insight is provided by Users. You are advised to treat any information contained within Comment and Insight with an appropriate level of caution. Users’ views are their personal views alone and neither CIPD nor its Subsidiaries are responsible for any content, unless specifically stated otherwise.
7.5. You may access other websites via hypertext links from the Website. You use such links and other websites entirely at your own risk. Such websites are provided by independent third parties and neither CIPD nor its Subsidiaries accept any responsibility for the availability, content or use of such websites or information contained on them. Any links to third party websites do not amount to any endorsement of that site by CIPD or its Subsidiaries.

8. Indemnity
8.1. You agree to indemnify and to keep CIPD and its Subsidiaries indemnified from and against any costs, claims, demands, expenses and liabilities suffered or incurred by CIPD arising from or which are directly or indirectly related to your access to and/or use of the Website and/or any other person or entity's use of the Website, including but not limited to where such person or entity was able to access the Website using your logon credentials.
