With many businesses working with reduced numbers of staff, a confident approach to performance management is essential. Whilst the aim of a good performance management programme should be to encourage employees to improve their performance, there will be occasions where employees who do not perform to the required standards will need to be dismissed.

At this session, employment law specialists from commercial law firm Burges Salmon, will consider how you can reduce your exposure to tribunal claims in this event:

  • Setting the scene
    - legal risks of a poor process;
    - effect of the ACAS Code of Practice;
    - the commercial reality.

  • Initial Stages
    - identifying poor performance;
    - deciding on a course of action;
    - counselling and informal action.
  • Formal Procedures
    - what is a fair process?;
    - sanctions;
    - appeals.
