Pauline McArdle is a partner specialising in UK employment law. She read law at Southampton University and originally qualified as a barrister. After 18 months she left the Bar and subsequently requalified as a lawyer. She has been a partner with the firm since 1999. She has specialised in employment law for over 20 years, and has advised both employers and employees in the public and private sector on all aspects of contentious and non-contentious employment law. She speaks frequently at conferences, conducts training workshops, has participated in live debates on Radio 5 and contributes to legal education videos and television programmes. She also writes for a number of publications, on a variety of employment-related topics.

Nicola Briggs is a senior associate specialising in UK employment law. She joined the firm in 2002 and qualified in September 2004. Nicola has experience in many aspects of UK employment law including a variety of both contentious and non-contentious matters. She has advised clients on managing the full spectrum of employment issues such as poor performance, misconduct and sickness absence and the issues arising on the termination of employment, including dealing with senior executive departures. She also has experience drafting and reviewing employment documentation including service agreements, contracts, handbooks and employment policies and procedures. Nicola has spoken at a number of seminars and has contributed articles to several publications.

Event details: A topical and in-depth look at the Agency Workers Regulations 2010 which came into force on 1 October 2011. These controversial regulations implement the EU Temporary Agency Workers Directive and give important new rights to assigned temporary workers. The talk will consider:

  • The scope of the Regulations and the BIS Guidance;
  • Who is an agency worker, what is a temporary work agency and how are intermediary bodies treated;
  • The day one rights for agency workers;
  • The right to equal treatment following a qualifying period;
  • Anti-avoidance provisions;
  • Derogations from the equal treatment principle;
  • Liability for breach, enforcement and remedies.
