Event details: Leading Employment Lawyers James Cox and Daniel Pollard from Gibson Dunn will present a “TUPE Masterclass for Beginners”. This is a “back to basics” session which will start at the beginning in order to give participants a clear basic understanding about when TUPE applies and the basic effects of TUPE applying. It is aimed at participants who either have no prior knowledge of TUPE or those who wish to consolidate their understanding of this technical area of law.

Whilst TUPE (the Transfer of Undertakings (Protection of Employment) Regulations 2006) is widely agreed to be one of the most difficult areas of employment law it is an essential area of expertise for HR practitioners whether in business, charities or the public sector. The session will provide a clear easy to understand explanation of the basis. As an aide memoire participants will receive a slide pack including diagrams, the key legal tests and names of the key cases.

Topics will include:
  • A world without TUPE
  • When does TUPE apply: the relevant transfer
  • Application to outsourcing and company sales
  • Which employees transfer?
  • Which liabilities transfer?
  • Enhanced Dismissal Protection
  • Objections and Constructive Dismissals
  • Changing Terms and Conditions
  • Employee Liability Information
  • Information and Consultation
After the main presentation (lasting approx. 1 hour) there will be an opportunity for you to speak with the presenters: the ideal opportunity to ask those tricky TUPE questions.

(Note: The same speakers will be presenting a TUPE Update event on 6 December 2011 which is intended for those who are already familiar with the basics of TUPE).
