CIPD Law on Tour Spring 2012 - background
There has rarely been a more challenging financial climate for employers with great uncertainty in the economy resulting in much organisational change. And, there has probably never been more contentious employment law reform afoot, either imminent, or proposed for the near future.
At the end of November 2011, the Government announced changes concerning employment law claims as a result of the Workplace Dispute Resolution consultation. These include extending the qualifying period for claims of unfair dismissal; changes to compromise agreements; mandatory early Acas conciliation; witness statement taken as read and no expenses for witnesses; payment for lodging a claim; increased deposits; judges sitting alone for unfair dismissal cases and financial penalties for employers found to have breached the law. The list of changes is vast, and many come into effect from April 2012. The CIPD Spring 2012 Law on Tour, running throughout the UK in April and May, is a great opportunity to find solutions to all your employment law headaches.
More controversially, the Government has recently launched two ‘Calls for Evidence’, on Collective Redundancy Consultation Rules and TUPE. Both ‘Calls for Evidence’ will result in consultation in 2012, and show a clear indication of the Government’s will to achieve reform in these two employment law mine fields.
The Redundancy document explores how businesses are hampered by collective consultation timescales and rules and how more meaningful employee engagement can be achieved. It also looks at the difficulties for businesses when TUPE and redundancy consultation is required, and calls for ideas on the removal of double consultation. The TUPE document explores the effectiveness of the 2006 regulations and whether they are over bureaucratic and might be improved upon.
